These Terms of Use (“Terms”) govern your access to and use of the SportsCard Scanner Pro mobile application (the “App”) and the website at www.sportscardscannerpro.app (the “Site”). By downloading, accessing, or using the App or Site, you agree to these Terms. If you do not agree, do not use the App or Site.
1. The service
The App provides tools to scan or search for sports trading cards, view information and market-related data, and manage a personal collection. Features may change over time. Some features may require a paid subscription or one-time purchase as offered through the App Store.
2. Eligibility
You must be able to form a binding contract in your jurisdiction. If you use the App on behalf of an organization, you represent that you have authority to bind that organization.
3. Apple App Store
If you obtained the App from the Apple App Store, you acknowledge that these Terms are between you and the operator of SportsCard Scanner Pro, not Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide support for the App. In the event of a conflict between these Terms and the App Store Terms of Service, the App Store Terms of Service apply to the extent required by Apple.
4. Subscriptions and payments
Paid offerings are billed by Apple. Prices, renewal, cancellation, and refunds are handled according to Apple’s policies and the purchase flow shown in the App. We may change prices or plans with notice as required by law and platform rules.
5. Third-party data and APIs
Card information, prices, and listings may come from third-party sources (such as database providers or marketplaces). We do not control and are not responsible for third-party accuracy, availability, or policies. Values shown are informational and not professional financial or appraisal advice.
6. Acceptable use
You agree not to misuse the App or Site, including: attempting to reverse engineer or scrape the service in violation of law; interfering with security; using the service to violate others’ rights; or using automated means to overload our systems without permission.
7. Intellectual property
The App, Site, branding, and our content are owned by us or our licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. Third-party names and data remain property of their respective owners.
8. Disclaimers
THE APP AND SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT RESULTS WILL BE ACCURATE OR ERROR-FREE.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE APP OR SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP OR SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (USD $50), EXCEPT WHERE PROHIBITED BY LAW.
10. Indemnity
You will defend and indemnify us against claims arising from your misuse of the App or Site or violation of these Terms, to the extent permitted by law.
11. Termination
We may suspend or terminate access if you violate these Terms or if we discontinue the service. Provisions that by their nature should survive will survive termination.
12. Changes
We may modify these Terms by posting an updated version on the Site. The “Last updated” date will change. Continued use after changes constitutes acceptance, except where additional notice is required by law.
13. Governing law
These Terms are governed by the laws of the United States and the State chosen by the operator of the App, without regard to conflict-of-law rules, except where your local law requires otherwise.
